On the following pages you will find our privacy policy. It provides information on how we collect, use and share or otherwise process data of our users, whenever they open and use our app, website or any other applications of the NYZZU MEDIA GmbH (hereinafter "NYZZU).
Please read this information carefully and make sure that your parents and legal guardians read it, too, and discuss it with you. Data privacy protection is important! Especially if you disclose personal information about yourself, you should give attention to the topic of “data privacy protection”.
When using our app, website or our other applications, NYZZU determines how the data and information our users provide will be handled. In this respect, NYZZU is referred to here as the “data controller”.
By reading this data protection guidelines, we want you to understand;
• what information we (have to) collect from our users,
• how we use the information,
• how and which information can be passed on to third parties,
• how and which data we store and how we protect our users' data,
• how you and your parents or legal guardians can control how your data is used,
• which other rights you are entitled to with respect to your data.
Again, Data privacy protection is important! We have the approach to collect, save, process, or pass on as little data from our users as possible. But please remember that you share your data, particularly images and other personal information about you, not only with NYZZU, but also with other users. You should always keep that in mind, and you should handle your data carefully.
Our privacy policy may change over time. The current version of our privacy policy is always published on our website ( www.nyzzu.com ) and in our app. In the event that we process or otherwise use the data your data other than specified in our privacy policy, we will inform you about it separately in advance, and we shall, if required, obtain the necessary approval.
Following hereafter, you shall find a summary of our privacy policy and subsequently the full information:
What kind of data does NYZZU collect?
When using the app, the website and the associated applications, we collect three basic types of information:
(1) information we query from the user and that the user actively provides. This includes personal data, e.g. to register for the app. And it is also information and data like images and other information that users publish in the app.
(2) Information that we collect automatically, e.g. via the smartphone, tablet or computer operated by the user. This is among other things the IP-address, a cookie-ID or a device-ID, that helps us to determine, which device is used to call up the respective app, website or application.
(3) If the respective user agrees, we apply tracking tools to gain data, which help us to better understand how our users work with the app, the number of users, number of sessions; session durations, app starts, operating systems; device identification for advertising (for example, Google ID or IDFA; device information and region).
Beyond the above there is no automated or technical analysis of user data, especially no analysis of images or text or friendship connections. We do not generate any personal profiles on consumer preferences or any other user profiles for any commercial purposes or alike. NYZZU does not generate any personal movement profiles or evaluates the contacts of the users for commercial purposes, which might be common with other providers and social media networks.
The above may not apply to our integrated partners (e.g. Spotify, Giphy, Unsplash), who may collect data in connection with the use of our service within our app and use same for their own purposes.
How does NYZZU utilize the user data?
We generally utilize our users' data for the following purposes:
1. Technical purposes, to
• ensure that only the authorized user can access the relevant application and no unauthorized person;
• ensure that certain functions and services work properly;
• communicate with our users and to answer user enquiries.
2. For marketing purposes, to
• understand how our users navigate within the app, the website and in our other applications, so that we are able to expand and improve our services;
• ensure that no inappropriate advertising is displayed or ads that are uninteresting or irritating to our users.
Otherwise, we only process your data to fulfill our legal obligations (e.g. retention obligations) or to safeguard our legitimate interests, provided that users interests are not prior-ranking (e.g. storage of data until the limitation period has expired).
How does NYZZU store my data?
The data of our German or European users is stored exclusively on servers in Germany or Europe and are therefore subject to the strict German and European data protection laws. This may or may not apply for users outside the EU, as the case may be. Cyber security and data encryption plays a major role for us and our security measures are subject to continuous monitoring. If you think that an unauthorized person may have accessed your data, please let us know immediately!
What information does NYZZU share with others and why?
As described above, we store data that the users provide or that are gained in a technical or automated manner. Was can (or must) pass on this data to third parties in accordance with the applicable privacy laws, for example to
• law enforcement authorities or others, to protect and defend our rights, the rights of our users or of third parties if necessary; • service providers or employees who work for NYZZU and support us in the operation of the app, the website or other applications;
• partners (e.g. IMG.ly, Spotify , Giphy, Unsplash ) that are offering their services within our app, website or applications;
• advertising partners who place advertisements within our app.
In particular, the transfer of user data to advertising partners takes place anonymously and without disclosing personal data. In this respect, it is conceivable that you will be shown advertisements for e.g. football even though you practice judo or prefer cooking. On the other hand; strictly speaking, it is nobody's business what you do, not even ours.
We provide our advertising partners with anonymous, non-personalised information on what age our users are. Teenage users should for example not be bothered by ads for pensioners. We also pass on the info of the gender of our users and in which area (postal code) our users live. That's it.
Do third parties collect information from our users?
Yes. For example, our partners IMG.ly, Spotify, Giphy and Unsplash can use device identifiers such as IP addresses or the respective API to track who is using their services through our app. However, we cannot see which data our partners collect while using their services. We are dedicated to reducing the data regarding users collected by third parties to an acceptable minimum, if we can.
We are however unable to comprehend to what extent the app stores of Apple and Google collect data from the users when downloading the app.
What are my rights?
In addition to other laws, the General Data Protection Regulation (GDPR) is the central law for data protection in Germany. According to this regulation, the user has the right, for example:
• to request access to the user data stored by NYZZU
• to complain about the handling of user data at NYZZU
• to have errors in saved user data corrected
• to have NYZZU delete stored data or information
• to receive a copy of the user data that Nyzzu has saved in order to transfer it to another website, application or other interactive service
In addition, each user or parents and guardians, can revoke a given consent for data collection, storage and other processing at any time (see in detail in the lower part of this data protection guideline).

NYZZU privacy policy
I. Collection, processing and use of personal data Personal information is any information that relates to an identified or identifiable natural person (e.g. the name, the address, telephone number, the date of birth or the e-mail address). "Processing" of personal data means that we may collect, save, use, transmit to third parties or delete this information.
NYZZU processes your personal data when
• you visit our website;
• you get in contact with us directly by phone, email or by other means;
• you install the NYZZU-app;
• you use the Nyzzu-app and/or the associated applications.
II. Personal data provided by the user
You provide us with some of the personal data when you use the NYZZU app or the website. Basically, you are only required to provide information that are necessary for the use of the app and we will inform you about those accordingly. All further information about your personal data is voluntary.
You may be offered to take part in surveys, promotions or a competition. The information requested from you in order to participate may include: (a) first and last name; (b) date of birth; (c) gender; (d) country; (e) state; (f) post code; (g) username and password; (h) mobile phone number; (h) email address; or (i) other profile information such as your preferences or interests. This data may be passed on to third parties for advertisement purposes. To participate is always voluntary and we will inform you separately about the processing of your data and your rights in connection with such action.
III. Automatically collected information
If you use our app or website or a related application, certain information about your use may be automatically collected. This may include information about your computer or mobile device, such as the type of operating system (e.g., Windows, Mac, iOS, or Android), IP address (a number assigned by your Internet service provider that can identify your device), web browser type (e.g., Internet Explorer, Safari, Chrome, and Firefox), unique device identifiers (or UDID, a persistent identifier for certain mobile devices), or other standard server log information.
IV. Use of personal data
The personal data provided by you or collected from you will only be processed by us if:
• we have your consent to do so based on Art. 6 (1) Subs. 1 lit. a DSGVO, or that of your parents or legal guardians. This consent can be revoked at any time;
• we need to use your personal data to fulfill our contractual obligations (in particular the provision of the app and its features) and our service to you according to our GTC on the basis of Art. 6 para. 1 Subs. 1 lit. b DSGVO;
• we have a legitimate interest in processing personal data based on Art. 6 para. 1 Subs. 1 lit. f DSGVO, e.g. to determine which part of the app is popular with our users and which part is less used, and to defend our rights and fraud prevention;
• we communicate with you (Art. 6 para. 1 Subs. 1 lit. b DSGVO);
• we can thereby prevent fraud or other unlawful conduct (Art. 6 para. 1 Subs. 1 lit. f DSGVO;
• we are legally obliged to do so (Art. 6 para. 1 Subs. 1 lit. c DSGVO).
V. Security of personal data
We pay attention to a high level of security when we collect or process your data. To this end, we apply effective technical and organizational measures. In this way we protect your data against manipulation, loss, destruction or against access by unauthorized persons. We improve these measures constantly and adapt them to the latest technological developments. The information collected by NYZZU is stored no longer than is necessary for the purposes described in this privacy policy or to otherwise comply with legal requirements.
Please note that uninstalling the NYZZU app on your mobile device does not automatically delete your data.
VI. Duration of data storage
We only store your data for as long as is necessary for the fulfillment of the purposes associated with the data collection - in particular the fulfillment of statutory retention requirements.
The data is generally deleted at the earliest after the statutory warranty obligations have expired; In the case of statutory archiving obligations, the deletion takes place after their expiry - according to the current legal situation, after up to 10 years.
VII. Personal data that is passed on to third parties
Personal data will only be given to third parties by NYZZU if this is necessary for the fulfillment of the contract and/or we have your consent to do so. If we transfer personal data to third parties based on a so-called "legitimate interest", we explain our legitimate interest in this Privacy Policy. In addition, personal data may be transferred to third parties if NYZZU is required to do so by law or by enforceable governmental or judicial order.
NYZZU may use service providers for the processing of personal data. Service providers will then receive from NYZZU only the personal data they need for their specific activities. These are, for example, service providers who provide us with their server capacities or are responsible for processing payments.
In addition, we may share information that is generic and does not identify an individual user. This involves, for example, information about whether the app is used by more male or female users and how. We may use this information to identify trends and share it with third parties, such as advertisers and business partners, to help them better understand our business.
In addition, the use of the NYZZU app requires that your profile information, text and images be shared with and visible to other NYZZU app users. Please note that the content and information you post may be visible to users in different countries, as you may connect with your friends from all over the world. It is possible that in these countries the protection of personal data is not guaranteed to the same extent as in Germany, because in these countries the laws may not provide protection for personal data that corresponds to the protection provided by the laws of the European Union. If you do not want this, we will not be able to provide you with our service as stated in our Terms and Conditions.
VIII. Data collected from third parties
NYZZU uses third-party services in the app, such as Spotify, Giphy and Unsplash. In addition, we work together with advertising networks and traffic analysts (tracking). While these third parties or advertisers do not have access to the tracking data we collect, they may set their own tracking technologies. The use of tracking-technologies by these third parties is not within our control.
IX. Push Messages
As part of using our NYZZU app, you will receive so-called push messages. These are messages that we send to you as part of the performance of the contract. You can turn this feature off with the according setting on your mobile device.
X. User rights
According to the regulations applicable in Germany, as a user of the NYZZU app, website and related applications, you have the following rights with respect to your personal data:
You have the right to request information about your personal data processed by us in accordance with Art. 15 DSGVO. In particular, you can request information about the processing purposes, the category of personal data, the categories of recipients to whom your data has been or will be disclosed, the planned storage period, the existence of a right to rectification, erasure, restriction of processing or objection, the existence of a right of complaint, the origin of your data if it was not collected by us, as well as the existence of automated decision-making, including profiling, and, if applicable, meaningful information about its details.
According to Art. 16 DSGVO, you have the right to request the correction of inaccurate or incomplete personal data stored by us without delay.
According to Art. 17 DSGVO, you have the right to request the deletion of your personal data stored by us, unless the processing is necessary for the exercise of the right to freedom of expression and information, for compliance with a legal obligation, for reasons of public interest or for the establishment, exercise or defense of legal claims.
Pursuant to Art. 18 DSGVO, you have the right to request the restriction of the processing of your personal data, insofar as the accuracy of the data is disputed by you, the processing is unlawful, but you object to its erasure and we no longer need the data, but you need it for the assertion, exercise or defense of legal claims or you have objected to the processing pursuant to Art. 21 DSGVO.
Pursuant to Art. 20 DSGVO, you have the right to receive your personal data that you have provided to us in a structured, common and machine-readable format or to request the transfer to another controller.
Pursuant to Art. 7 (3) DSGVO, you or your parents or legal guardians have the right to revoke your consent at any time. This has the consequence that we may no longer continue the data processing, which was based on this consent, for the future.
In accordance with Art. 77 DSGVO, you have the right to complain about us to the competent supervisory authority.
If you believe that our handling of your personal data violates applicable law, please contact us. We will do our best to address your concerns.
XI. Right to object to processing
According to Art. 21 GDPR, you have the right to object to the processing of your personal data that is based on our or a third party legitimate interest (in particular for the purposes of usage analysis and needs-based design of the website), provided there are reasons for this from your devoted particular situation or the objection is directed against general or tailored and direct advertisements. In the latter case, you have a general right of objection, which we will implement without you specifying a particular situation.
If we process your personal data for direct advertisement, you have the right to object at any time to the processing of personal data for the purpose of such advertising. If you object to the processing of your personal data for direct marketing purposes, we will no longer process your personal data for these purposes.

XII. Contractual or legal obligation to provide your data
You are neither legally nor contractually obligated to provide us with your data. However, you may not be able to use our app and website or individual services offered via them if you do not provide us with your data.
XIII. Automated decision making including profiling
An automated decision-making, including profiling does not take place.
